2. Purposes and legal basis of processing

The Company processes personal data provided by a candidate as part of an application for employment, engagement, or work on a project for the purpose of receiving and recording the application, communicating with the candidate, assessing whether the candidate meets the requirements for the position, engagement, or project, and conducting the selection process.

If relevant to the specific position, engagement, or project for which the candidate is applying, the Company may make the candidate’s personal data available to the Company’s clients and business partners who participate in the assessment of candidates and the selection of persons for work on that project or engagement.

The processing of personal data in connection with the ongoing selection process, including the provision of data to a client or business partner participating in the selection of candidates for a specific project or engagement, is necessary for the purpose of considering the candidate’s application and conducting the selection process prior to the potential conclusion of an employment contract or another form of engagement.

After the completion of the specific selection process, the Company may retain the candidate’s CV and other application documentation for the purpose of considering the candidate for future employment, engagement, and work on the Company’s projects, as well as for considering suitable candidates for the Company’s clients and business partners for future project engagements, where relevant to a specific future project or engagement.

This additional processing is based on the Company’s legitimate interest in maintaining records of candidates who have expressed interest in employment, engagement, or work on the Company’s projects, in contacting them regarding future suitable opportunities, and in considering suitable candidates with clients and business partners for project engagements within the scope of the Company’s business.

3. Categories of personal data

The Company may process personal data contained in the candidate’s application and accompanying documentation, in particular: first and last name, contact details, information on education, professional qualifications, certificates, skills, language knowledge, and work experience, as well as other data provided by the candidate, to the extent relevant to the employment, engagement, or project.
The Company does not request the submission of special categories of personal data unless this is explicitly necessary and lawful for a specific purpose. The candidate is kindly asked not to provide such data unless specifically requested.
The Company will process only data that is appropriate, relevant, and limited to what is necessary for the specific purpose of processing.

4. Recipients of data and transfer to other countries

The candidate’s personal data may be available to:

Authorized employees and engaged persons of the Company who need such data for the purpose of conducting the selection process and deciding on employment, engagement, or work on a project;
Contractual processors who provide technical, administrative, or organizational support to the Company, subject to appropriate safeguards; and
Clients and business partners of the Company who participate in the assessment of candidates and the selection of persons for a specific project, engagement, or position.

Such clients and business partners may be based in Bosnia and Herzegovina, European Union Member States, and other countries.
If necessary for the purpose of conducting the selection process for a specific project or engagement for which the candidate has applied, or for considering the candidate for future projects and engagements in accordance with this Information Notice, the Company may transfer the candidate’s personal data to recipients in other countries.

In such cases, the Company will ensure that the transfer is carried out in accordance with the applicable rules on international transfers of personal data and, where applicable, on the basis of:

an adequacy decision; or
other appropriate safeguards in accordance with applicable personal data protection regulations.

The candidate may request from the Company additional information on the categories of recipients, the countries to which the data is transferred, and the safeguards applied, as well as information on how to obtain a copy of such safeguards or where they have been made available.

5. Retention period

The Company will retain personal data from the application during the specific selection process and for as long as necessary to complete related activities and, where applicable, to protect the rights and interests of the Company.

After the completion of the specific selection process, the Company may retain the candidate’s CV and other application documentation for the purpose of considering the candidate for future employment, engagement, and work on the Company’s projects, as well as for considering suitable candidates with the Company’s clients and business partners for future project engagements, for a maximum period of 2 two years from the date of submission of the application.

Upon expiry of the applicable retention period, the Company will delete, anonymize, or otherwise cease processing the personal data, unless there is another legal basis for its further retention.

6. Candidate’s rights

The candidate has the right to request from the Company access to their personal data, rectification of inaccurate data, completion of incomplete data, deletion of data, restriction of processing, objection to processing where the legal requirements are met, as well as the right to data portability where the legal requirements are met.

The candidate also has the right to lodge an objection with the Personal Data Protection Agency in Bosnia and Herzegovina and/or file a lawsuit before the competent court.

7. Obligation to provide data

Providing personal data necessary for the consideration of the application is a necessary condition for the Company to be able to assess the candidacy and conduct the selection process.

If the candidate does not provide the data necessary for the specific application, the Company may not be able to consider the application or continue communication regarding employment, engagement, or work on a project.

If, for a specific project or engagement, it is necessary for a client or business partner to participate in the selection of the candidate, failure to provide the data necessary for such assessment may mean that the Company will not be able to consider the candidate for that specific project or engagement.

8. Retention and use of application documentation for future needs

After completion of the specific selection process for which the candidate submitted an application, the Company may retain the candidate’s CV and other application documentation for the purpose of considering the candidate for future employment, engagement, and work on the Company’s projects.

Given the nature of the Company’s business and the fact that the Company provides services to clients and business partners, including clients and business partners outside Bosnia and Herzegovina, the candidate’s application documentation may, where relevant to a specific future engagement or project, be made available to the Company’s clients and business partners for the purpose of assessing the candidate and selecting persons to work on such project or engagement.

This processing is based on the Company’s legitimate interest in maintaining records of candidates who have expressed interest in employment or engagement with the Company, in contacting them regarding future suitable positions, engagements, or projects, and in considering suitable candidates with clients and business partners for project engagements within the scope of the Company’s business.

The Company will retain the application documentation for this purpose for a maximum period of 2 years from the date of submission of the application, unless the candidate objects to this processing earlier or requests deletion of the data.
The candidate has the right at any time to object to this processing or request deletion of their application documentation. In such case, the Company will stop using the candidate’s application documentation for future employment, engagement, and project opportunities, including disclosure to clients and business partners, unless there is another legal basis for further limited retention of the data.

If the application documentation is provided to clients or business partners outside Bosnia and Herzegovina, the Company will carry out such transfer only in accordance with the rules on international transfers of personal data and with the application of appropriate safeguards, where required.
